1. Zustimmung zu den Bedingungen

Durch den Zugriff oder die Nutzung der Website von METAL GEAR (METALGEAR.co.com), der Handelsplattform, Software-Wallet, API oder verwandter Dienstleistungen stimmen Sie diesen Nutzungsbedingungen zu. Wenn Sie einem Teil dieser Bedingungen nicht zustimmen, müssen Sie die Nutzung unserer Dienstleistungen sofort einstellen. Diese Bedingungen gelten für alle Benutzer, einschließlich Einzelhandelshändler, institutioneller Kunden und API-Benutzer.

2. Berechtigung & Kontoregistrierung

Um METAL GEAR-Dienste zu nutzen, müssen Sie:

  • Mindestens 18 Jahre alt sein oder die Volljährigkeitsalter in Ihrer Gerichtsbarkeit haben
  • Nicht in einer Gerichtsbarkeit ansässig sein, in der METAL GEAR-Dienste verboten sind
  • Nicht als Einzelperson oder Unternehmen auf einer Sanktionsliste aufgeführt sein (OFAC, EU, UN usw.)
  • Vollständige KYC- und Identitätsprüfungsverfahren durchlaufen
  • Während der Registrierung genaue, wahre und aktuelle Informationen bereitstellen
  • Nicht mehrere Konten erstellen, um Grenzen oder Beschränkungen zu umgehen
  • Alle geltenden Gesetze, Vorschriften und MiCA-Anforderungen einhalten

METAL GEAR behält sich das Recht vor, Dienstleistungen zu verweigern oder Konten von Benutzern, die diese Anforderungen nicht erfüllen, zu kündigen.

3. Risk Disclosure & Trading Warnings

CRITICAL RISK WARNING: Cryptocurrency trading and digital asset investment carry substantial financial risk, including the potential loss of capital. Past performance does not indicate future results.

  • Market Volatility: Cryptocurrency prices are highly volatile and can fluctuate rapidly
  • Liquidity Risk: Some trading pairs may have low liquidity, resulting in slippage or execution delays
  • Technology Risk: Digital asset trading relies on internet connectivity and platform availability
  • Regulatory Risk: Cryptocurrency regulations are evolving; changes may impact asset values or trading access
  • Counterparty Risk: Fiat transactions depend on banking partner performance and stability
  • Custody Risk: While we use cold storage, no system is 100% secure against theft or loss
  • Fraud & Scam Risk: Users should never share private keys, seed phrases, or credentials with anyone

By using METAL GEAR, you acknowledge these risks and confirm that you trade at your own risk.

4. Account Security & User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including:

  • Your email address and password
  • Two-factor authentication (2FA) codes and backup codes
  • Your private keys and seed phrases (in non-custodial wallet mode)
  • Any API keys or authentication tokens used for platform access

You must notify METAL GEAR immediately if you suspect unauthorized access or account compromise. METAL GEAR is not liable for losses resulting from unauthorized account access due to user negligence, weak passwords, or phishing attacks.

5. Trading Rules & Prohibited Activities

Users agree not to engage in the following prohibited activities:

  • Pump-and-dump schemes or market manipulation
  • Wash trading or spoofing
  • Insider trading based on non-public information
  • Using automated bots without explicit authorization
  • Placing orders with intent to cancel immediately (layering)
  • Depositing or trading funds derived from illegal activities
  • Circumventing KYC/AML procedures or providing false information
  • Harassing or threatening METAL GEAR employees
  • Attempting to hack, disrupt, or compromise platform security
  • Using the platform on behalf of sanctioned individuals or entities

Violation of these rules may result in immediate account suspension, funds forfeiture, and referral to law enforcement.

6. Trading Fees & Charges

METAL GEAR charges transparent fees for platform services:

  • Maker Fee: 0.08% (Starter tier: 0.15%)
  • Taker Fee: 0.10% (Starter tier: 0.15%)
  • Withdrawal Fee: Variable by blockchain and network congestion
  • Fiat On/Off-Ramp Spread: 0.5–2% depending on payment method and volume
  • Subscription Fees: As disclosed for Pro and Analytics Add-on tiers

All fees are displayed before transaction confirmation. METAL GEAR reserves the right to adjust fees with 30 days' notice. Fee changes will not apply retroactively to executed orders.

7. Intellectual Property Rights

All content on METAL GEAR's website and platform — including text, graphics, logos, images, software code, and documentation — is owned by or licensed to METAL GEAR SAS and protected by EU and international copyright, trademark, and intellectual property laws.

You may view and print content for personal, non-commercial use only. Reproduction, distribution, modification, or transmission of content without written permission is strictly prohibited.

8. Limitation of Liability & Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, METAL GEAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

METAL GEAR's liability for damages arising from your use of our platform is limited to:

  • Direct damages only; no consequential, indirect, or punitive damages
  • The lesser of: (a) the amount of fees paid in the last 12 months, or (b) €100

This limitation does not apply to personal injury, death, or fraud.

9. Termination & Account Closure

METAL GEAR may terminate or suspend your account immediately if:

  • You violate these Terms of Use or applicable law
  • We detect fraudulent or suspicious activity
  • You are found on any sanctions list or regulatory exclusion list
  • We determine your account poses a compliance risk
  • You request account closure

Upon account closure, we will return any remaining account balance to your registered withdrawal address within 30 days, minus applicable fees. After closure, trading is disabled, but you may withdraw your assets.

10. Dispute Resolution & Complaints

Informal Resolution: In case of dispute, contact METAL GEAR Support at support@metalgear.co.com. We will attempt to resolve issues within 15 business days.

Formal Complaints: If informal resolution fails, you may lodge a formal complaint with:

  • METAL GEAR's formal complaints department
  • The competent EU financial authority in your member state
  • A court of competent jurisdiction in Paris, France or your jurisdiction

All disputes are governed by French law and the exclusive jurisdiction of Paris courts, except where EU consumer protection directives provide otherwise.

11. Datenschutz & Datenschutz

Ihre Nutzung von METAL GEAR unterliegt unserer Datenschutzrichtlinie. Wir erfassen und verarbeiten personenbezogene Daten wie in dieser Richtlinie beschrieben. Durch die Akzeptanz dieser Bedingungen erklären Sie sich mit der Datenverarbeitung wie in unserer Datenschutzrichtlinie beschrieben einverstanden.

12. Gesamte Vereinbarung & Änderungen

Diese Nutzungsbedingungen, zusammen mit unserer Datenschutzrichtlinie und Cookie-Richtlinie, stellen die gesamte Vereinbarung zwischen Ihnen und METAL GEAR dar. Es gelten keine anderen Zusicherungen oder Vereinbarungen.

METAL GEAR kann diese Bedingungen jederzeit aktualisieren. Die weitere Nutzung unserer Plattform nach Aktualisierungen zeigt die Akzeptanz der neuen Bedingungen an. Wir empfehlen, diese Seite regelmäßig zu überprüfen.
